c 7 ORDINANCE WHEREAS, the Winnebago County Board of Health believes that it is t.ek-f~assary that an Ordinance be enacted to protect the health and rights of smokers and non-smokers within the County, and; WHEREAS, the hazards of tobacco smoking to both the smoker and the non-smoker have become known and established, and; WHEREAS, the County Board of the County of Winnebago has carefully studied this matter and concurs with the Winnebago County Board of Health. e NOW, THEREFORE, BE IT ORDAINED, that the following Ordinance is hereby adopted. This Ordinance, passed this 3~~« 1976, amending and adding to the Winnebago County Health Ordinances as follows: ARTICLE IX. Prohibition of Smoking: Sec. 9-110. Definitions For the purpose of this Article, the words "smcke" or "smoking" refer to a lighted cigarette, cigar, pipe, or any other lighted smoking equipment. 2. "Properly designated smoking area" means any area set aside specifically for those who wish to smoke, the location and ventilation of which will keep the non-smoking area free from ambient smoke. Sec. 9-111. Smoking Prohibited It is unlawful, except as specifically provided herein for any person to smoke in any hospital, sanitorium, nursing home, home for the aged, school or college, public health care facility, any room where -a meeting is being conducted by the Winnebago County Board or its committees, the City Council or its committees, the Board of Education

K'v or its committees, or any other public body, commission, committee. or pt`)lic meeting while said meeting is in progress, public museum, lecture hall or library EXCEPT in private rooms, offices, or properly designated smoking area; in elevators; in a theater or performance hall, EXCEPT on stage when smoking is part of the performance, or in an auditorium or performance hall substantially open to the sky; in rest- aurants or cafeterias, EXCEPT in properly designated smoking areas, in private rooms and offices, or during a gathering or party of a pri- vate group. • In a restaurant with seating capacity of 50 persons or less, exclusive of counter space, the proprietor may choose to permit or pro- hibit• smoking by properly posting the.premises. Notwithstanding the above, smoking is permitted in any place during the time it is not open to or in use by the public. Sec. 9-112. Posting of Signs. The proprietor or other persons in charge of any place for which this Smoking Ordinance is applicable shall comply with this Ordinance and also shall post in conspicuous parts of such place in letters of sufficient size and boldness to be easily read, signs identifying the ~ , areas where smoking is permitted or prohibited. Sec. 9-113. Violations and Penalties. . Any smoker, proprietor or any other person in violation of this Ordinance shall be subject to the penalty provided in Section 9-6 of these ordinances, which is a fine of not less than $10. 00„ nor more than $200. 00 per violation. Sec. 9-114. Enforcement. The Winnebago County Health Department, as well as all legally constituted municipal or county law enforcement authorities, shall have the responsibility of enforcing this Ordinance. BE IT FURTHER ORDAINED, that the above stated Ordinance is in full force and effect 1976.
