AND RETAIL CLERKS UNION LOCAL 648 INVOLVING THE DISCHARGE OF JACK HAMM Dear Pat: Enclosed for your review and files is a copy of Arbitrator John Phillip Linn's Opinion and Award with reference to the above- captioned matter. As you will recall, the case involved an employee who was discharged following his refusal to check out a customer who was smoking. Arbitrator Linn concluded that the Grievant's actions constituted insubordination. In dealing with the Union's arguments regarding the Shimp case, Arbitrator Linn concluded that there is no basis to adopt the New Jersey common law in California.
