THIS MATTER having come up on a Motion for Summary Judgment by the
Defendants, JOSEPH ORTHOEFER, PAUL J. BENGSTON, EUGENE EBENS, and the
COUNTY OF WINNEBAGO, by their Attorneys, PHILIP C. REINHARD, State's
Attorney, by Assistant State's Attorney, DAVID L. MARTENSON, and upon
the Complaint for Declaratory Judgment and Permanent Injunction by the
Intervening Petitioner, CITY OF ROCKFORD, a Municipal Corporation, by
its Attorneys, A. CURTIS WASHBURN, STEPHEN W. McCARTY, and JAMES C.
SMITH, and the Court having considered the arguments of counsel and the
matters contained in the pleadings, the Court finds as foZlows:
1. That it has jurisdiction over the subject matter and the parties
hereto.
2. The Court finds the issues' for the Defendants on the Motion for .
Summary Judgment and against the Intervening Petitioner, the City of
Rockford; on the Complaint for Declaratory Judgment and Permanent Injunctio
3. That in support of this order the Court finds that the City of
Rockford does not have a "No-Smoking" health ordinance but instead h~ts a
fire protection ordinance. The Court further finds that the City has no
full time health officer to enforce a "No-Smoking" health ordinance.

IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED that the
Defendants take judgment against the City of Rockford, the Intervening
Petitioner, on the Defendant's Motion for Summary Judgment and that the
Complaint for Declaratory Judgment and Permanent Injunction he dismissed,
costs paid.
