Klein and a jury at a Trial Term, Part 5 of this Court, held at the courthouse thereof, on the 26th, 29th, and 31st and the lst, 2nd and 5th days of May and June, 1978, respectively, and the Plaintiff, Robert Brian Associates, Inc., having appeared by its attorney, Leonard R. Glass, Esq., and the Defendant, Loews Theatres, Inc., having appeared by its attorneys, Paul, Weiss, Rifkind, Wharton and Garrison and the issues having been duly tried, and a jury having rendered a verdict on the 5th day of June, 1978 in favor of the Plaintiff, Robert Brian Associates, Inc., and against the Defendant, Loews Theatres, Inc. in the first cause of action in the sum of Ninety Thousand ($90,000) Dollars by a unanimous vote of 6-0, and in the second cause of action, in the sum of Ten Thousand ($10,000) Dollars, by
