Vice President - General Council Lorillard 200 East 42nd Street New York City, Few York 10017 Dear Arthur: In sesrching our record files, it reveals that we have preset,ted the Grocery Bag promotion on several ocassions to your Company personnel as follows: On September 15, 1970 to Irv Gubervsan, Product `anager, P,ent Cigarettes. Mr. Guberman liked it well enough to invite us to present it to himself and Mr. John Bresnahan, Vice President Marketing, at the NYU Club in the Board Room, over luncheon, on May 21, 1971. Prior to the luncheon date, we reviewed it again with Mr. Guverman in his office on '•iay 15, 1971, we designed base displaya and counter displays as visual Graphics to support the promotional campaign theme. We left all visual graphic presentation materials with Hr. Guberman on that date. We worked on the Grocery promotion internally starting on July 27, 1970 along with many other project themes. I also call your attention to the fact that our records reveal that on October 8, 1970 we presented to your Company, a Steak Rnife promotion and a Thermo Coffee Mug promotion, both of which were later used as major promotional efforts by your Company. It is noted at this tiae we did not receive any of the finished artwork or production on these oriqinal ideas submitted to you during the period in which our contract was in force.

The lzteak Xnife promotion, planned for March and April of 1972, was subnitted to Frank 0'Connor on November 5, 1971 in a ten-page report as an original idea of Robert Brian Associates. At this writinq, we have two unpaid invoices which you are, as you put it, investioating and as you mentioned on the phone yesterday, will have final dispolition fo_ us by March 12. In our relationship with you, you have been fair and iust in disposing of such matters and we have very reason to believe that you will understand the reason for our invoices and the claims we have against your Company.
