C Concerning the abovementioned meetingi, the following gentlemen were in attendance: Jack Kelly, Mike Kerrigan,"_ RicScanlan,, Jim~ Heddeni,John D~onnelly,Joe Katz, Clark Martin, Bernie Robinson, Ken Wel ls and~ Larry Bewley. The seven key issues discussed were as follows: (1) ven- tilation and energy study; (2) economic impact study; (I3) Free Choice Committee spokespeople; (4) witness list; (I5) Legislative Oversight Committee; ('6) public relations campaign; (7) company people involvement. 1. Ventilation and Energy Study Jim Hedden will meet with Grad Partnership on Decem- _. ber 1 to receive the final draft of the ventilatio and energy study. He will forward a copy toiShook, Hardy & Bacon, the Washington office of TI, Mathtechl, and Joe Katz. A. A. Schechter will meet with the professional engineer (Chet Vogel) to prepare a press announcement relating to the Grad Study. Following the review of this study, it will be deter- mined when the New Jerseyans for Free Choice Committee will go public with the report findings. 2'., Economic Impact Study Mathtech has completed alpreliminary study of the economic impact of the regulatio s and expects to have the final statement completed no later than. December 7, 19,7'8'. The economic impact statement will include aspects of the Grad Partnership Study. The economic impact study will be forwarded on December 7th to the Washington office and to those referred to in, #1. ,;

Free Choice Committee Spokespeople Garry Shaw, President of the New Jersey Hotel/Motel Associatio:n, has agreed to~ act as co-chairman~ and spokesman of the New Jerseyans for Free Choice. Fred Schnweiss, owner of the Town and Country Restaurant, will also act as co-chairman~ and act in the same capacity as Garry. A., A. Schechter and a representative from T'.,I.'s Washington office will assist in training these co-chairmen for their future duties. 4. Witness List In addition to the four physicians who will attend, as a result of Shook, Hardy & B'acon"s efforts. (Dr,., RdmundiFisher, Dr. DomingoAviado, Dr. Dunca~nHutcheson and Dr. Reuben Cohen), the list of the other witnesses who will make statements at the December llth hearing are as follows: (a) Restaurant Association,-- Clark Martin and'Fred Schnweiss; (b) Hotel/Mote1 Association -- Garry Shaw, Jack 0''Cbnner and Frank Ponbo; (c), New Jersey Conference of Mayors -- Joe Stillo; (d) New Jersey Culinary Workers Union -- Frank McBride ; (e ) Police Benevolent Association,-- State President Frank Genesi; (,f) City of' Patterson -- Miayor Pat Kramer; (g) Tobacco Distributors -- Herb Leftkowitz; (h)' Mathtech -- Dr. Dan Cullen; and (i )' Grad' Partnership- Chet _ Vogel; (j) Tobacco Institute -- Walker Merryman ('Walker will act as a summary witness recapping the abovementioned) . Legislative Oversight Committee The Legislative aversight Committee expects to meet December 7th to review with the Public Health Council the Committee"s concerns expressed in their committee report of May 51, 1978. John Donnelly will attend the meetinig of the Oversight Committee and report back all the developments to us. The New Jerseyans for Free Choice will not be present at the meeting as we inter- pret the appropriate statues to preclude the Committee from attending a legislative session, lest it be con- strued~aslobb~ying a,legislativebody. Otherwise, wewould' have to goithirough an elaborate reporting proce- dure which we currently do not envision. Since our

(Exhibit #2, Action Plan, November 15, 1978) 6. Public RelationiCampaign of radio stations with addresses, phone numbers and times of programs for a caill-in campaign to be coordinated by the company representatives who attended yesterd'ay"s meeting. A. A. Schechter will also work with the spokespeople of the Committee to prepare mailings to association and local county political leaders for distribution after January 1, 1979. prepare letters to the editor, and provide names A. A., Schechter will "merchandize"' all releases, Member Company Employee Involvement . Jersey sales personnel to encourage greater wholesale, vendor, and retailer activity ('i.e. letters to the Cr Public H'ealth Council, contributions to the New ~ Jerseyans for Free Choice radio call-in and~other , , ~ participation as appropriate) consistent with their W normal sales activity. W C1T it was agreed by the company representatives present (Messrs. Bewley, Robinson and Wells) that their companies would act forthwith upon points one and two of the November 15, 1978 Action Plan concerning tobaccolcompany involvement. That is, they would' utilize exhibits #7 (background letter), #'8, and #9' (sample letters) which each company would communi-" cate to their own employees in the state. Also, it was requested that (Point three, page 4, 11/'15/78' Action Plan) the member companies would have 12' of their own employees who reside in New Jersey attend the hearings on Deceznber 11thi. Furthermore, the three company representatives present agreed that as soon as the radio station call-in list was provided to them, they would encourage their employees to '"call in"' to the radio station,, the coordination of which would'be handled through the same company repre- sentatives and Ric Scanlan. Finally, the company representatives present agreed~to utilize their New

Shinn and Sirridige on December 5th in T.I.'s Washington,office to further coordinate the above- . mentioned points.
