CIGARETTES AND FOR TOBACCO PRODUC'EDI
FOR CIiGARETTE SMOKING
Assemblyman Lei',chter in New York has iintroduced H 1759, which would make it a misdemeanor
to advertise iln any medium p1tobacco products."
"Tobacco products" here has a unique definition: "'.,.cigarettes and any other smok-
ilmg tobacco or tobacco product produced for the smoking of cigarettes."

5ecti:oni1'. The general busiiness law is.hereby amend'ed by adding thereto
a new section to be section three hundlred thirty-five-b, to read as
fo I llow s :
Secti'on 335-b., Advertising tobacco products. A person is guilty of
advertising tobacco products when (a). he advertises tobacco products,
or (b) with knowl'edge.of its contents, he publishes any publication
iin any medium, containing any tobacco advertisement of tobacco prod-
ucts, or (c) intending such advertisement to be published, sold or'
dfist.ribu.tedin the state of New York or with knowledgee that it i';s
intended to be published, sold'or distributed iin the state of New,
York, he sol'icits for publication, accepts for publication,, or
prepares for publication any adverti,sement of tobacco products.
For the purposes of this section,,"'advertisi.ng" and "adverti'sement"
shalll', mean the.solici'ting of any person, for profi,t,, to purchase or
use the product ad.verti'sed;, but such terms shaI.ll not.be.t deemedtorefe:r to. displaying
aiproduct for sale, whether in a wrapper or
other packi'ngmate.ri'a.l or not, without additionall advertising
materials,,at the point of sale. "Tobacco products" shall mean
cigarettes and any other smoking tobacco or tobacco product pro-
duced for the.smoking,of cigarettes.
Advertising tobacco products is a class A misdemeanor.
Sectiion 2. This act shalll take effect January filrst, ninteen hundred
seventy-one.'
Previously, Sen., Myerson had introduced S 6287, which iis identical with Assemblyman
Eink"s H 1503. We are awaitingicopiles of these bills, which would prohibit advertising
cigarettes in any media (TMA's S-LEG-7D-4). O
