710N d' 11YORK ANTI-Si1'0'KINGi BILL 0 STATE 78-2'I May 12,, 1978' In State Legislative Budletin 78-19, we indicated that the comprehensive Wew York bi11, H 85650,, designed to seriously restrict smoking areas, was defeated'in the Assembly by a 73-55'vote and that Mr. Grannis' (the sponsor)' bbid' to have the bill 'starred''' was denied. The origi'na1 denial' was overrul'ed'though there seems to be some confusiion ass to how thi s was accompll i'shed. Iln any event, yesterday at 2:00' M'r. G rann ils re- . moved the star and submitted a series of amendments to H' 8565r that he hopes wiill make the bi ll' more paJatable to its ad'versaries. Though the defini'ti'on of 'smokiing area" is virtually the same, M'r. Grannis has modi'fied a number of other defihitions. A"pllace of work" would be any area where 2 or more individuals perform ai task for consiideration of payment. If the work pl'ace is less thani 1'0'00 sq,. ft., however, smokiing would be restricted. only if a majority of'the workers choose this option. The proprietor would be effectively removed fromithe d'eci'sion-maki'ng process. Bars, areas whi'eh can be designated in theiir entirety as smoking areas, are more specificalily d'efiined as places, the prtinci'pal functton of' which iis to dispense alcohol. Regarding restaurants, perhap the main area of contentlon, Mr. Grannis proposes that those seati..ng 150 or less be allowed to designate the entire area as a smoking area provided that the seatiing area is not dlivided into two dining halls. If the sea ti'ng; area i'is so divided, then! the proprietor has a responsibi lity to establish a nonsmoking area. Nevertheless, tn restaurants not so diivi'd'ed„ the proprtetor is req;uired, to post signs askiing, customers to, voluntarily refraiin, from smoki'ng,. As~~semb l~y~~ f~loo~r~~ act i~on iis not expected befo~re~ Wed'nesd~a~y„ May~ 17'. -flEh:+s~ARc REPRESEivTk'TIVELl^''iCNi SEEKS SCHOOL SMOKING CURB On May 2, Representative Lynch introduced House Bill 899, a measure that would prohibit smoking by all persons "on any, pub3ic or private school property" in DeZaware. The:chii'efschool' of'fiicerofeaeK school di'stri'ct wou1'dberesponsilbl~e for enforci!ngi the ban. Violators would' be fined' not less than $10 nor more than $255 for each offense. H 899 was referred to the Education Committee. ~ LEGISLATIVE SESSPONS ~. 6.~.
