Times recaps the si!tuationlin Westchester, but erroneously reports thatt the newest version of the propose-Tanti-smoking ordin- ance has been forwarded to the State Department of Health. Dr. E'. Franklin Hall of'the Board'of Health says that the "'finalized" draft (icopy enclosed) is now being revitwed for legal language andigeneral compliance with, other pro- visions of the Cbunty's Sanitary Code before submission to Albany and to the County Attorney''s office. He always adds that this is merely a formality, and the only result expected is some comment. The only change is this current draft is the delettion of a final sentence from Sec. I, sub.5: "'I'f'the proprietor does not choose to voluntarily designate separate and'non- smoking areas, the proprietor will be responsible for provid'ing, adequate vent- ilation, which will defined at a later date." Inclusion of this provisionihiad created much confusion andd protests by the restaurant owners. It is clear that the Board realized the difficulty not only in defining what is Q. "'adequate ventilation, " but also the impossibility of en- forcing such a requirement. This has been the pattern of ~ the Board, to retreat slightly when there was strong opp- ~ osition, but always determined to get some ordina;nce on Q, the books. ~p N The Board of Health is meeting this Thursday, December 2'1 and it is uncertainiwhetherlthis matter will be on the agenda.
