This~Ac~~t~may be~ cited as~ the Ciga- rette rette Advertising Package Depiction Act of' 1971. 6 Section 2. For the purposes of'this Act-- 7 (a) The term "printed media"" shall include news- O C.J 8 papers, magaziines,, and' other periodicals pub]lished ~ U't EJ1'

1 and distributed in the United Sta.tes, including, 2 newspapers, magazines, and other periodicals dis- 3 tributed primarily to members or units of the 4 Armed Forces of the United States located abroad, 5 and advertisements appearing on billboards in the 6 United States, but shall not include tobacco trade 7'•publications. 8 (b)The term "package'"' shall mean a cigarette. 9 package or carton of cigarette packages., 10: Section 3. It shall be unlawful for any person ~ 11 to advertise cigarettes in any printed media w3thout' 12 including a depiction of the cigarette package so 13, as legibly to show the.health warning required in ~ 14 section 4 of this Act, or in lieu of such depiction 15 a legible statement of the health warning required 16 in section 4 of' this Act . 17 Section 4. The health warning to be depicted 18 in accordance with section 3 of this Act shall read: 19 "Warning: The Surgeon General Has Determined That 2'C Cigarette Smoking Is Dangerous To Your Health." 21 Section 5. (a) No statement relating to smok- 22 ing and, hea]ith,, other than the statement provided by 213' section 4 of this Act, shall be required iniany ad- 24 vertising in any printed media. ,

1 (b) No~requirement or prohibition based on 2' smoking,and health shall be imposed under State 3' law with respect to the adverti:sing or promotion 4 of cigarettes which~ are advertised in conformity 5 with the provislons ofthis Act. 6 Seetion 6. Any person who violates the provi- 7 sions of'this Act shall be guilty of a misdemeanor 8 and' shall on conviction thereof be subject to~ a P 9 f'ine of not more than $11a,000. 10 Section 7'. If any provision of this Act or 11 the appl'ication thereof to any person or circumstances 12' is held invalid, the other provisions of' this Act 13 and' the application of such provision to other 14 persons or circumstances shall not be affected 15 thereby. 16 Section 8'. This Act shall become effective six 17' months af'ter the date of' enactment .
