"We're fighting a war," s;iid Foote, the advertising exec-whose anti-smoking TV commercials
were considered exc;,ptionally effective. "We're dealing with an industry that justifies the taking
of i>.ulral
lives to make profits. We need a militant group to carry on that _fight. ..and -do what we have to
do to
protect the health of the American people against the tobacco industry."
When Shubil; made his re f?ort to NDAB-June 20, the board accepted his recom-
mendation for a permanent cmte. with adequate board representation. Shubik
said he would serve on the cmte. but did not want to be chairman. The board
also considered a resolution by Mary Lasker, calfing-for regulation of the tobacco
industry by the new Federal Product Safety Commission. The resolution was
tabled when the board k.'E;s advised that the law creating the commission specif-
ically exempts tobacco and _tobacco products froln its jurisdiction. FDA is
similarly enjoined from dealing with the tobacco industry.
NCAB failed to-take action on another resolution-oJ'fcred-by Shubik, to "reaffirm its belief
that the majority of lullb cancers -_ the nrost_ frequently occurrinL cancer in US nlales - woulll
be pre-
vented by cessation of smoking, and that other cancers and ConI111U11 causes 0f death would be
reduced
by a_ reduction in cigarette smoking." Other board members objected, citing lack of scientific proof
that
lung cancer could he "prevented" by cessation of snlol:in!T.
"Wouldn't the word 'clilliinish' 11be lb.tter than `prevent'.'" r4rabbcniloft asked. Sllullil: in--
sisted that there is overwhelming evidence the "majority" of lu!lt; cancers %:'ould be prevented.

Panel Chairman Benno Schmidt pointed out that ending snlokitlg might not prevent cancer i.^n someone
