This letter will confirm our discussions with
you concerning the fact that the time you expend on matters
related to The Council's research progra^ is so frequent and
intermitter.t that it is virtually impossible to relate it to
a per dien basis. Therefore, The Council, beginning
aover.ber 1, 1972, will conoensate you for your advice and
consultation by a fixed fee.
This fee will be figured at the rate of $15,000.00
per annucs and will be paid to you at the end.of eac:i month in
an amount of $1,250.00. It is unde.-stood'that The Council
will rjake no withholdings for tax or Social Security alt:~ough
the fee will of course be reported at the end of the year to
the Internal Revenue Service~on Forn 1099.

Dr. Sommers has resigned as Research Director of The
Council but will remain a member of the Scientific Advisory Board,
continuing to act as its Chairman and as a member of the Planning
Committee.
Dr. Gardner is to become Scientific Consultant to The
Council as of July lst. During the next twelve months Dr. Gardner
will devote approximately half of his time to The Council. After
that it is anticipated that his appointment will be on a full-time
basis.

All of us owe a great deal to Dr. Somzaers for his
outstanding leadership and service during the years he served as
Research Director. He gave generously of his time, often at great
sacrifice and inconvenience to himself. His wisdom, knowledge and
good humor helped enormously.

letter from Zurich typed on CTR stationery and sent
to the newspaper. Your letter had two minor errors
of fact -- it was the Washington Star, not Post, and
the officials were from the D.C. medical society. ,

the point you made -- that slience might indicate
assent.
Incidentally, I did not get a copy of the Star
letter until yesterday. A copy is enclosed.

Dear Sir:
May I correct the statement of three officials
of the Medical Society of the District of Columbia that by
my not personally reviewing the Auerbach smoking dog material,
in some way the claims made are supported. Simply stated,
by premature publicity for their annual fund campaign the
Cancer Society violated due scientific process and was
thereby hurt. Failure of the J.A.M.A. to publish the study
indicated seiious defects. Four investigators I respect
who were close to the situation found no squamous lung
carcinocr.a deronstrated. The evidence in the Dece:nber medical
literature is unconvincing. No one is likely to use this
experimental model again, since $750,000 was spent and zero
squamous carcinomas can be accepted as produced. It is another
of many experiments in which inhaled cigarette smoke did not
produce cancer.

The matter of cose-response clri:as rela ~ing cigarette smoking
to disease was discu;sed at length at a neetino ;r the Subcor.mittee of t_'le
Joint Ccr.mittee on Tobacco and ::ea1=z. There se=:..-a-d to be agreement t::at
dose-res: onse was a c=cper tern when applied to -fa..rious physiological and
biochemical events, like heart rate and oxygen =er_s::n;tion, but that tne
term could not oro=erly be arplied to disease endr:oints. In other words,
dose-response is a misused tem in this context.
If you simply -ean that people who smok:e higher tar and nicotine
cigarettes are supposed to get diseases and die e,--rlier than those ::ho smoke
cigarettes with lower -sr and nicotine, I know of no data that demonstrate
such a relation conviningly. The orelininary ser ::~rts coroaring filter a nd
nonfilter cigarettes do not permit any definite cc.-iclusions.
3. Do you believe there is a suitAble bio =assay model for lung

This is difficult to acconplish, unless I were to conduct a
poll by mail or personal intervie,:rs. However, if v ' ou read the reccrd of the
1969 House Co%merce Co-:7ittee Hearings, catholcgi_=ts who testified to this
effect included Drs. Victor B,.Lhler, arthur Furs:, :ailliam B. Ober, R. H.
Rigdon, John P. Wyatt and Irving Zeidman. Statements were provided by Drs.
H. Russell Fisher, Doris L. Herman, Cecile Le::chtenberger and Rudolf
Leuchtenberger, Walter S. Priest and Lucio Severi. All those above are
identified as pathologists or experi^ental patholc3ists by training, practice
or both. Eight are from the U.S., and all have scent years in the field of
diseases claimed to be related to smoking. If time and funds permit, a
further listing could be compiled, but a pertinent quotation from Dr.
Ralph R. Stevens is: "Biologic phenomena cannot be determined in a democratic
manner." At last week's oathology convention 4 of the 6 men sitting closest
to me were smoking cigarettes and another cigars. Let us acnit that
uncertainty and controversy in the field of s^akir.g and health are rPal,
serious and that the basic questions remain unanswered.

Planning Committee. All of us owe a great deal to Dr. Sommers whose

On February 5, Drs. Oscar Auerbach and E. Cuyler Hartmond
presented to the press at a special meeting held in conjunction with the
meeting of the American Cancer Society Board of Directors the findings
of their study on "The Effects of Cigarette Smoking Upon Dogs." The
American Cancer Society at that time issued a "Backgrounder" interpreting
the results of the experiment as a significant achievement representing
the first time that scientists have produced lung cancer in a large ex-
perimental animal as a result of heavy smoking. The Cancer Society's
release further claimed that these findings should have a significant impact
on the smoking of cigarettes and on the advertising claims and policies of
the cigarette industry. The report and these interpretive comments have
been given wide publicity.
As you may know, there have been previous studies with cigarette
smoke in which the initial report has,claimed that lung cancer -- resembling
lung cancer in humans -- was induced in experimental animals. These were

proved either wrong or of little significance after the results were subjected
to rigorous scientific examination. Other developments in connection with
smoking and health have sometimes been announced under impressive auspices
such as a major university -- and, after evaluation, have been found to dis-
appoint their sponsors.
Since the American Cancer Society asserts that the present
study is of considerable import to the tobacco industry, I believe that
the industry is entitled to have a full understanding of the nature and
significance of the findings as quickly as possible. In the interest of
accomplishing this aim, I request that the American Cancer Society permit
a thorough evaluation of the experiment and its results by.a panel of
independent scientists with wide experience in areas relevant to the data.
I propose that we proceed as follows: The American Cancer
Society shall notify me whether they and the investigators will agree to
permit access to the relevant materials and data by a panel of scientists.
Upon being notified that the material will be made available, I shall
nominate as reviewers several well known scientists highly qualified

in the fields of experimental work, tumor pathology and lung diseases,
who, I believe, would be recognized by the Cancer Society and by their
colleagues as men of outstanding competence and integrity. Naturally,
none of these men will be connected with the tobacco industry. If the
Cancer Society should, for good reason, reject any of the men whose.names
I offer, I would appoint a substitute. The tobacco industry will, of course,
bear all costs in connection with this review.

that this work may cqmmence at the earliest possible date.
