The Volusia County, Florida, Medical Society met in early January 1985 ..~:.
and agreed to propose an-anti-smoking ordinance to the Volusia County .... ~~.
Council to prohibit or restrict smoking in all public buildings and in ~]~,i

A draft of the ~proposed ordinance is expected to be submitted by the ÷~i~-
end of January to the Council, and it is anticipated that public
hearings'will begin shortly thereafter. Last year Ormond Beach (one

of the cities in Volusia County) considered such an ordinance, but ........
bpted for a voluntary program.

Direct Lobbying. The Regional Director will arrange one-on-one ~

Legislative Support. Plans are being made to contact local allied

groups such as the Restaurant Association, Hotel and Motel

Association, retail grocers and department stores to defeat the

with local agricultural groups.

Contact their friends and business acquaintances to request that
they too contact the City Council members.

Write "lettel:s to the editor" of the Ocala Star Banner, the only
daily newspaper that covers this county.
Upon review of the lobbying laws of the State of Florida, Covington
and Burling has determined that the actions requested herein do not
require participants to register as lobbyists.
Please contact Hurst Marshall with your approval of the requested
action and with recommendations that you may have for additional
activity.

SUGGESTED LETTER TO FLORIDA TAN VOLUNTEERS IN VOLUSIA COUNTY
January 15, 1985
Dear TAN Voluntee].~:
Recently, the Volusia County Commission received a proposal to adopt
an anti-smoking ordinance. If adopted, it would severely restrict or
even ban smoking in all public buildings and perhaps even in many
private business establishments. The proposed ordinance was referred
to the County Council for consideration. This proposal will be heard
by the County Council in the very near future.
If you believe as we do that this proposal is unreasonable,
unnecessary and unenforceable, then we urge you to contact your County
Council and County Manager to express your opposition to such an
ordinance. I am sure that you agree that we need less governmental
interference and 1~egulation in our daily lives.
On the reverse side of this letter are the names, addresses and phone
numbers of the members of the County Council and County Manager.
You'll also find a list of points you can make in your calls and
letters (in your own words, please).
We also request that you contact your friends and solicit their
support in opposing the adoption of an anti-smoking ordinance. When
and if such an ordinance is introduced, we would appreciate your
attending the County Council meeting.

SUGGESTED POINTS TO MAKE
I •
Laws that attempt to restrict smoking or to segregate
smokers in public places are of such low priority to the
police that Izhey receive little or no attention• This lack
of attention further erodes confidence in enforcement
agencies•
•
Limited manpower and funds make it difficult for the police
to perform current duties in an effective and efficient
manner• Real and serious threats to public safety demand
our fullest attention.
•
The fact thai: some persons derive enjoyment from smoking
must be considered along with the preferences of nonsmokers•
When tobacco is used in a courteous and considerate manner,
it reflects a reasonable accommodation for smokers and
nonsmokers alike• Courtesy has been repeatedly found to be
the most workable solution.
•
The answer to the public smoking issue is not to waste the
taxpayers' money by passing unenforceable laws which do more
harm than good; rather the answer lies in more courtesy on
the part of some smokers and more tolerance on the part of
some nonsmokers.
•
The restrictive smoking proposal is an excellent example of
the kind of burdensome, unnecessary ordinance that citizens
of Volusia County do not need.
•
Smoking is a matter of personal choice and an activity that
is best governed by common courtesy.
•
At a time of soaring rates and limited state and local
monies, implementing this would clearly be a waste of fiscal
and human resources.
•
Furthermore, there is already too much government intrusion
into the lives of private citizens•
•
Any real or imaginary problems that exist between smokers
and nonsmokers can be resolved by common sense, tolerance,
and courtesy.

I resent further attempts to legislate personal habits which
this restrictive smoking proposal certainly does.
