As I mentioned briefly at Wednesday's meeting, the
National Association of Motor Bus Owners presently has pending
before the Interstate Commerce Commission a petition request-
ing that the smoking section for interstate buses be changed
from 20 per cent to 50 per cent of the capacity of the bus.
Notice of the filing of the petition and providing an. oppor-
tunity for comment was published by the ICC in the Federal
Register of August 18, 1975. A copy of the Federal Register
notice is enclosed.
There were relatively few comments filed with the
ICC. The most extensive were filed by Action on Smoking and
Health (ASH) on September 30, 1975. A copy of the ASH comments
is enclosed. As they indicate, various additional documents
were included~ in the filing. These apparently consisted of:
A basic flier describing ASH, together with a
number of other fliers or pamphlets on smoking
and health, reprints of articles from. magazines
on Banzhaf, and reprints of material from the
Congressional Record.

There is also enclosed a copy of a complaint filed
in the Federal District Court in Dallas by the ICC against
Continental Trailways. This complaint, which charges viola-
tion of the ICC regulations on smoking on buses, has j,ust
been made available to us through the good: offices of Nambo.
